Sarah Phelan, instructed the East Midlands Crown Prosecution Service, appeared for the Crown and prosecuted a Derby man who pleaded guilty on the morning of his trial to rape. The defendant attacked the complainant, when she was heavily intoxicated, having taken her back to his flat under the guise of protecting her when she was paralytic through drink and drugs and was not capable of consenting.

HHJ Smith QC imposed a sentence of 10 years and 9 months.
